- Kicukiro Court Remands Barafinda, Others for 30 Days
Kicukiro Primary Court remands five suspects for 30 days over alleged spread of false information on YouTube platforms. The Primary Court of Kicukiro has ordered a 30-day provisional detention for five individuals accused of publishing false information through YouTube channels. The suspects — Mazimpaka Patrick, Nizeyimana Didier also known as Muchoma , Barafinda Fred Sekikubo , Nkeramihigo Japhet and Tumukunde Juma, also known as Fitboy Djuma — appeared before the court on February 19, 2026. The hearing was conducted in camera in consideration of court interests and national security concerns. According to the prosecution, Barafinda Fred Sekikubo allegedly collaborated with Mazimpaka Patrick and Nkeramihigo Japhet to organize and broadcast discussions on YouTube channels including Umurwa Live TV , Ndasiganwa TV and Saneza TV . Prosecutors argue that the content was intended to spread false information and incite public discontent against the government. The court heard that the accused reportedly assigned roles among themselves, including moderating discussions, filming and editing content, uploading videos to YouTube, and sharing advertising revenue generated from online views. One of the statements cited during proceedings referenced remarks made during a broadcast that later circulated widely on social media platforms. Following the dissemination of the content, investigations were launched, leading to the arrest of the initial suspects. Authorities later detained Nizeyimana Didier, said to own three YouTube channels — Saneza TV , Sana TV Show and Mucoma Sana — along with his employee Tumukunde Juma. After reviewing arguments from both the prosecution and defense, the court ruled that the suspects be held for 30 days to allow further investigation into the alleged offenses. Under Rwandan law, the accused have five days to appeal the decision. - ANC threatens court action over DA Lesufi shower billboard
ANC threatens legal action after DA refuses to remove billboard mocking Gauteng Premier Lesufi during water crisis. South Africa’s ruling African National Congress (ANC) has threatened legal action against the Democratic Alliance (DA) over a billboard mocking Gauteng Premier Panyaza Lesufi following controversial remarks he made during Johannesburg’s water crisis . The dispute erupted after the DA unveiled a large billboard on 3 March depicting Lesufi taking a shower, referencing comments he made in February that he had sometimes gone to hotels to bathe during water supply disruptions. According to the ANC, the image was digitally manipulated and used without authorisation. In a letter sent on 5 March, attorney Mongezi Ntanga demanded that the opposition party remove the billboard and related social media posts within 12 hours. The ANC argues the image is demeaning and damages the reputation of the Gauteng premier. The party warned it could seek court action under the Electoral Act’s Code of Conduct if the material remains online or displayed publicly. The controversy stems from remarks Lesufi made on 11 February during a briefing on Johannesburg’s worsening water shortages. At the time, he said that in some cases he had gone to a hotel to bathe before attending official commitments. The comment drew sharp criticism from residents frustrated by recurring water outages, prompting the premier to later apologise. The DA quickly turned the incident into a campaign message, placing Lesufi’s image in an advertisement divided into two sections. One side, in ANC colours, shows the premier showering , while the other, in DA blue, carries the slogan “Vote DA to put water in your taps.” DA federal council chairperson Helen Zille said the party would not comply with the ANC’s demand to remove the billboard. She argued the ruling party had not provided a valid legal basis for its request and framed the dispute as a question of political expression. “The ANC cannot cite any legal reason as to why the billboard should be removed,” Zille said, adding that the party would not meet the 12-hour deadline. ANC Gauteng spokesperson Mzi Khumalo criticised the billboard as insensitive to residents struggling with unreliable water supply, saying the opposition was turning a complex infrastructure challenge into a campaign gimmick. The dispute now raises the possibility of a legal confrontation over political advertising and the use of AI-generated images in campaigning. The ANC’s legal argument references the Electoral Code of Conduct, though the code generally applies only once an election date has been formally announced. Online reaction to the controversy has also been significant, roughly 25,000 posts on X discussed Lesufi’s hotel-bathing comments, quickly turning the issue into a high-visibility political flashpoint. - Booysens court shooting linked to Mondeor murder trial: Nel
Two died and three were wounded when gunmen opened fire outside Booysens Magistrate’s Court after a pre-trial in a 2025 Mondeor murder case. Two people were killed and three others wounded in a shooting outside the Booysens Magistrate’s Court in Johannesburg on Tuesday, after a court appearance connected to a 2025 murder case, authorities said. Gauteng police spokesperson Brigadier Brenda Muridili said initial information indicates a group leaving the court was targeted in the court precinct . She said the accused in the related case was present but was not hurt during the incident as reported by IOL Deputy Justice Minister Andries Nel said officials from the justice department were briefed by the South African Police Service following the attack. He linked the incident to a matter stemming from a fatal stabbing at a Mondeor pub last year, describing Tuesday’s appearance as a pre-trial conference ahead of the trial, which he said was scheduled to begin on 28 January. According to Nel, the shooting happened in the parking area as the accused who is out on bail left with family members and a legal representative. Police later confirmed one of the injured was the accused’s lawyer, Paul Lisher. - Tshisekedi: No Military Conquest Will Become Political Legitimacy"
Tshisekedi says armed groups cannot turn military conquest into political legitimacy, separating the DRC national dialogue from AFC/M23 talks in Doha. President Félix Tshisekedi has drawn one of the clearest boundaries yet around the DRC’s new national dialogue: armed groups cannot fight the constitutional order, occupy Congolese territory or act on behalf of a foreign power and then use “inclusivity” to claim political legitimacy. KINSHASA, — August 29, 2026 — President Félix Tshisekedi has sought to remove a potentially explosive ambiguity surrounding his newly announced national dialogue, declaring that armed movements fighting the Congolese state will not be admitted as political components of the process while they remain under arms. The message was unusually explicit. “No weapon will confer upon its bearer a right superior to that which suffrage recognizes for citizens.” Tshisekedi followed that statement with an even firmer principle: “No military conquest can be converted into political legitimacy.” The significance goes beyond rhetoric. By separating the national dialogue from the ongoing Doha process involving AFC/M23, Tshisekedi is attempting to prevent the new initiative from becoming a political route through which territorial conquest could eventually be converted into positions, institutional influence or recognition inside the Congolese political system. Tshisekedi Rejects the Idea That “Inclusivity” Requires Armed Groups One of the most important passages of Tshisekedi's speech directly addressed the argument that a genuinely inclusive national dialogue must automatically accommodate armed movements. Continue Reading Full Article JUSTICE & CRIME Tshisekedi: No Military Conquest Will Become Political Legitimacy" By Serge Kitoko Tshibanda Political Analyst Serge Kitoko Tshibanda Home Comment Aug 29, 2026 Aug 29, 2026 10 min read Copy link Facebook X (Twitter) WhatsApp Published Updated: President Félix Tshisekedi has drawn one of the clearest boundaries yet around the DRC’s new national dialogue: armed groups cannot fight the constitutional order, occupy Congolese territory or act on behalf of a foreign power and then use “inclusivity” to claim political legitimacy. The President rejected that interpretation. “No armed movement may invoke inclusivity to impose by force what it did not obtain through democratic means.” That sentence establishes the political logic behind Tshisekedi's position. Congolese political parties and citizens compete for power through elections and constitutional institutions. Under the framework outlined by the President, taking territory by force cannot give an armed organization political rights superior to those obtained through the ballot box. It represents an attempt to draw a line between political opposition, which Tshisekedi says belongs inside democratic debate, and armed rebellion, which will be handled through security, peace and demobilization mechanisms. Who Exactly Is Excluded? Tshisekedi did not leave the exclusion criteria vague. According to his speech, groups or actors will not participate in the national dialogue as political components if, when the process begins, they are: fighting the constitutional order with weapons; occupying part of the national territory by force; illegally administering entities of the Republic; or acting in the service of a foreign power. Tshisekedi then explicitly identified that foreign power as Rwanda. That wording unmistakably places the current AFC/M23 rebellion at the center of the restriction, reflecting Kinshasa's position that the movement operates with Rwandan military backing. The Rwandan government has repeatedly disputed the DRC government's characterization of its role and says its security concerns are connected in particular to the FDLR and threats against communities in eastern Congo. But Tshisekedi's speech was not presented as an invitation to renegotiate those competing narratives. It was a declaration of the rules governing his domestic national dialogue. The Critical Distinction: Doha Is for AFC/M23 Tshisekedi also addressed an obvious question: if AFC/M23 cannot participate in the national dialogue as an armed political component, where will negotiations concerning the conflict take place? ADVERTISEMENT His answer was Doha. “The Doha process remains the appropriate framework for dealing with AFC/M23 on issues relating to the cessation of hostilities, disengagement, cantonment, disarmament and other modalities directly linked to the conflict.” This is arguably the most important structural element of the announcement. Tshisekedi is creating two separate tracks. The national dialogue concerns the political and institutional future of the Congolese Republic. The Doha process remains the framework for dealing with AFC/M23 on the armed conflict. The President stressed that one process would not replace the other. “The national dialogue will not substitute itself for this process.” That separation is intended to prevent the domestic dialogue from becoming an alternative negotiating channel through which an armed movement could transform battlefield leverage into political concessions. No Parallel Route From Battlefield to Political Power Tshisekedi was particularly direct on this point. He said the national dialogue: “Will not become a parallel route allowing people to obtain through arms what democracy and the constitutional order have not granted.” That statement addresses a sensitive issue in Congolese political history. Successive conflicts have repeatedly forced the Congolese state to confront the question of how former armed movements should be incorporated into post-conflict political and security arrangements. Tshisekedi's new formula attempts to distinguish individual reintegration after disarmament from political recognition obtained because an armed organization captured territory. The distinction is fundamental. Under the framework he announced, laying down arms can open a route back into the national community. Remaining armed does not create an entitlement to political representation. The Door Is Not Completely Closed to Individual Fighters Tshisekedi's position is therefore not simply “no reintegration.” The President explicitly said a path back into the national community would remain available to individuals who abandon armed struggle. ADVERTISEMENT But he attached conditions. Individuals would have to sincerely and verifiably renounce armed engagement and all forms of violence. They would also be required to unequivocally condemn what Tshisekedi described as the aggression against the DRC. Those individuals could then be handled through the country's Disarmament, Demobilization, Community Recovery and Stabilization Program (P-DDRCS), alongside applicable justice and reconciliation mechanisms. This creates an important distinction between reintegration of individuals and political legitimization of an armed organization. A fighter can potentially return to civilian national life after abandoning violence. An armed movement cannot, according to Tshisekedi's framework, retain its weapons and territorial leverage while simultaneously demanding recognition as an ordinary political actor. Tshisekedi Is Trying to Remove a Major Fear Around the Dialogue The announcement of a national dialogue immediately raises difficult questions in a country still facing armed occupation in parts of its eastern territory. Among them is whether “inclusivity” could eventually mean bringing AFC/M23 into a broader political settlement. Tshisekedi's speech appears deliberately designed to answer that concern before the dialogue begins. His position is essentially that inclusivity has constitutional limits. Political disagreements can be debated. Opposition parties can challenge the government. Communities can demand reforms. Civil society can criticize institutions. But an organization cannot, under the President's framework, fight the Republic and simultaneously demand the privileges attached to democratic political participation. ADVERTISEMENT Tshisekedi described this not as discrimination based on identity, opinion or affiliation, but as a consequence of taking up arms against the state. “Peace Cannot Mean Impunity” There is another important qualification. Disarmament does not automatically erase responsibility for crimes. After explaining the reintegration route available to individuals, Tshisekedi issued a warning: “Peace cannot mean impunity.” That sentence will matter when the dialogue moves from political principles to implementation. DDR programmes are designed to remove fighters from armed organizations and facilitate their return to civilian life. Justice mechanisms address a different question: whether individuals bear responsibility for crimes committed during conflict. Tshisekedi's formulation suggests the government does not want reconciliation to be interpreted as automatic immunity. Exactly how that principle will operate in individual cases will depend on the eventual mechanisms and judicial processes. A Different Definition of National Dialogue Tshisekedi is therefore presenting the initiative as something fundamentally different from negotiations with a rebellion. The national dialogue is supposed to answer questions about peace, national cohesion, governance, institutions and the refoundation of the Congolese state. The armed conflict has its own negotiating track. This also explains another major declaration in Tshisekedi's broader speech: the dialogue, he said, will neither constitute negotiations with what he called “the aggressor or its proxies” nor provide a disguised mechanism for overturning the political order established through the 2023 elections. The existing institutions of the Republic are to remain in place and continue exercising their constitutional mandates. In other words, Tshisekedi is proposing dialogue within the Republic rather than renegotiation of the Republic under military pressure. - Ingabire Victoire Returns to Court Over Controversial Article 106
Rwandan opposition leader Victoire Ingabire challenges Article 106 in the Supreme Court, arguing the law undermines judicial neutrality. Rwandan opposition figure Victoire Ingabire appeared before the Supreme Court this week as her legal team challenges a controversial provision of Rwanda’s criminal law. The case focuses on Article 106 of the penal code, which her lawyers argue violates constitutional principles and undermines judicial independence. Ingabire, a long-time government critic and leader of the unregistered political movement DALFA–Umurinzi, is asking the court to strike down the article, saying it conflicts with Rwanda’s Constitution. At the center of the dispute is a legal power granted to judges under Article 106. The provision allows a judge to order the investigation of a person who has not been formally charged by prosecutors if the judge believes there are indications that the individual may have been involved in a crime. Ingabire’s lawyers argue that this authority crosses a critical legal boundary. In most judicial systems, they note, the responsibility to investigate and bring charges belongs to prosecutors, not to the court itself. Allowing judges to initiate such actions, they say, risks blurring the separation between investigation and judgment. What Is Article 106, and Why Is Ingabire Concerned? Article 106 of Rwanda’s criminal procedure law allows a judge to request an investigation into a person who has not been formally charged by prosecutors if evidence during a trial suggests that the individual may have participated in the alleged offense. Ingabire’s lawyers argue that the provision risks undermining judicial neutrality by allowing courts to initiate investigations — a role normally reserved for the prosecution. For Ingabire, the concern is also personal. Her lawyers say Article 106 was the legal basis used by a High Court judge to order an investigation into her during a separate trial involving nine individuals described by authorities as supporters of her political movement, DALFA–Umurinzi. At the time, Ingabire was not initially a defendant in the case. However, after hearing testimony during the proceedings, the judge invoked Article 106 and directed that she also be investigated. Her defense argues that this sequence raises serious questions about judicial neutrality A Case Rooted in a Larger Trial Continue Reading Full Article ELECTIONS Ingabire Victoire Returns to Court Over Controversial Article 106 By Neema Asha Mwakalinga Travel & Culture Expert Neema Asha Mwakalinga Home Comment Mar 5, 2026 May 15, 2026 6 min read Copy link Facebook X (Twitter) WhatsApp Published Updated: Rwandan opposition figure Victoire Ingabire appeared before the Supreme Court this week as her legal team challenges a controversial provision of Rwanda’s criminal law. ADVERTISEMENT At the time, Ingabire was not initially a defendant in the case. However, after hearing testimony during the proceedings, the judge invoked Article 106 and directed that she also be investigated. Her defense argues that this sequence raises serious questions about judicial neutrality A Case Rooted in a Larger Trial The legal challenge stems from an earlier case involving nine individuals described by authorities as members or supporters of DALFA–Umurinzi , the political platform founded by Ingabire. Those individuals have spent nearly five years in detention facing charges that include conspiracy against the government. During proceedings in that case last June, a High Court judge invoked Article 106 to order an investigation into Ingabire herself, leading to her arrest. Her legal team says the decision represented an unusual intervention by the court in prosecutors' work. Bruce Bikotwa, one of Ingabire’s lawyers, told the Supreme Court that the judge who ordered the investigation also imposed a 15-day deadline for the inquiry, before potentially presiding over the same case. According to the defense, this situation raises concerns about judicial impartiality. “The principle of separation of powers requires that each institution act independently,” Bikotwa argued. ADVERTISEMENT Defense Questions: Earlier Investigations Ingabire also told the court that the allegations against her had already been examined several years ago. She said investigators reviewed similar claims roughly four years earlier and found no evidence of wrongdoing, which led to her release. The opposition leader denies any involvement in the crimes attributed to the nine accused individuals. She suggested that one of the testimonies linking her to the case may have been influenced by security services. Government Position Although the Rwandan government is not formally a party to the case, a state representative was invited to provide explanations during the hearing. Lawyer Speciose Kabibi, speaking on behalf of the government, defended the judge’s decision to order an investigation. She told the court that when a judge encounters evidence suggesting another person may have participated in a crime, it can be appropriate to request further inquiry. Kabibi also rejected the claim that the judge improperly directed prosecutors, saying the order only initiated an investigation and did not determine its outcome. “If the investigation had found no evidence, she would have been released,” Kabibi said. Ingabire has long been one of Rwanda’s most prominent opposition voices. Since returning from exile in 2010 to run for president, she has faced repeated legal battles and periods of detention. Supporters view her current challenge as an effort to test the limits of Rwanda’s judicial independence and constitutional protections. Her lawyers argue that the outcome could influence how courts balance judicial authority and prosecutorial power in future cases. Awaiting the Court’s Decision After hearing arguments from both sides, the Supreme Court announced that it will deliver its ruling on the 27th of this month. The decision will determine whether Article 106 remains in Rwanda’s criminal code or whether the court finds it incompatible with constitutional guarantees. For Ingabire and her supporters, the case represents another chapter in a long struggle over political space and legal accountability in Rwanda.
